If you’re behind on mortgage payments in Texas, it’s important to take action as early as possible. Many homeowners wait because they feel overwhelmed or unsure what to do next, but exploring your options early may help you avoid foreclosure and protect the equity you’ve built in your home.
Texas primarily uses a non-judicial foreclosure process, which means lenders usually don’t need to go to court to begin foreclosure. Instead, the process follows a series of notices and legal steps that can lead to a public auction of the property.
Foreclosure can move relatively quickly in Texas. The full process may take around three to six months in many cases, depending on the lender and circumstances.
Once a notice of default is issued, homeowners typically receive at least 20 days to cure the default before a notice of sale can be sent.
Texas law allows lenders to foreclose outside the court system through a trustee sale if the loan includes a “power of sale” clause. The process doesn’t require court approval, so it can move faster than in states with judicial foreclosure systems.
In many cases, BounceBack works with homeowners to explore solutions that may help them remain in their homes while stabilizing their finances. The goal is to provide structure and time so homeowners can determine their best long-term option while protecting their equity.
(3) If you have an hoa, community board, or pud committee, they are contacted by BounceBack or your attorney for a closing package so bounceback can operate the property DURING YOUR PROGRAM.
(2) The amount of cash advanced, if any, is dependent on the appraised value of your home and the agreed to debts that need to be paid off. In many instances BounceBack is unable to advance any cash at closing. For example, if total paid off debt at closing is greater than 60% of appraised value, we will not be able to advance any cash.
(1) Estimated Net Equity is the estimated net value based on the current appraisal, less your mortgage payoff and other agreed-upon debts, your cash-upfront payout, and BounceBack’s fees, related financing costs, transaction costs, and closing costs, all of which are subject to changes in the home’s value. For example, if the home’s value decreases due to market conditions or failure to properly maintain the property, the estimated net equity will decrease. The estimated net equity also assumes that you make all required contractual rental payments. If you fail to make any rental payments, your estimated net equity will decrease.
