FAQs

What should I do if I’m behind on my mortgage in South Carolina?

Foreclosure goes through the court system, so many homeowners assume they have plenty of time. But during that time:

  • Interest, fees and legal costs can continue to grow
  • The lender is still moving the case forward
  • Your available options may become more limited

Common first steps include:

  • Understanding how far behind you are
  • Reviewing your loan and any notices you’ve received
  • Exploring ways to resolve the situation before a foreclosure judgment is entered

Even if you’re already behind, there may still be options available.

South Carolina is a judicial foreclosure state, which means lenders must go through the court system to foreclose.

The process generally includes:

  • The lender files a lawsuit (complaint) against the homeowner
  • You are formally served with legal papers
  • You have time to respond to the lawsuit
  • The court may issue a judgment of foreclosure
  • The property is scheduled for a public auction

The courts can make the process feel slower, but it is still actively moving forward the entire time.

Foreclosure in South Carolina typically takes longer than in non-judicial states, often several months or more.

However, that timeline can vary depending on:

  • Whether the homeowner responds to the lawsuit
  • Court schedules and delays
  • Any negotiations or legal actions taken

Even though the process may take time, it doesn’t pause on its own. Costs and pressure can build throughout.

Yes, homeowners in South Carolina have important legal rights during foreclosure.

These may include:

  • The right to be formally notified through a lawsuit
  • The right to respond and present a defense in court
  • The right to be informed of the foreclosure judgment and sale
  • In some cases, the right to request a deficiency judgment hearing

Homeowners do have more formal opportunities to respond in South Carolina, but must take action to use those rights.

If you do not respond to a foreclosure lawsuit in South Carolina, the court may enter a default judgment against you.

A default judgment means:

  • The lender can move forward without your input
  • A foreclosure judgment may be entered more quickly
  • Your home may be scheduled for sale

Responding can help preserve more options.

In some cases, yes.

Options may include:

  • Bringing the loan current by paying missed amounts
  • Negotiating a loan modification or repayment plan
  • Filing for bankruptcy, which may temporarily pause the process
  • Exploring alternatives that resolve the situation before the sale

The earlier you act, the more flexibility you may have.

(3) If you have an hoa, community board, or pud committee, they are contacted by BounceBack or your attorney for a closing package so bounceback can operate the property DURING YOUR PROGRAM.

(2) The amount of cash advanced, if any, is dependent on the appraised value of your home and the agreed to debts that need to be paid off. In many instances BounceBack is unable to advance any cash at closing. For example, if total paid off debt at closing is greater than 60% of appraised value, we will not be able to advance any cash.

(1) Estimated Net Equity is the estimated net value based on the current appraisal, less your mortgage payoff and other agreed-upon debts, your cash-upfront payout, and BounceBack’s fees, related financing costs, transaction costs, and closing costs, all of which are subject to changes in the home’s value. For example, if the home’s value decreases due to market conditions or failure to properly maintain the property, the estimated net equity will decrease. The estimated net equity also assumes that you make all required contractual rental payments. If you fail to make any rental payments, your estimated net equity will decrease.
